Commission Terms And Conditions

By accepting these Terms and Conditions you, the buyer, (referred to as “COSTUMER” in these Terms and Conditions) are entering into a legally binding contract with the artist, RIVARS, (referred to as “ARTIST” in these Terms and Conditions).

1. DEFINITIONS

ARTIST” means the person who creates ARTWORK according to COSTUMER’S requirements.

ARTWORK” means the pieces of digital art product such as COMIC or SPRITE or ILLUSTRATION which ARTIST creates.

COMIC” means a digital image sequence with text which are used to express a story. Each COMIC page itself is in digital version in A5 (1748 x 2480 pixels) size with resolution 300 dpi in PNG format if not agreed otherwise. Each COMIC page can contain not more then 8 panels.

COMMISSION” means ARTWORK which is supplied according to the COSTUMER’S requirements so the COSTUMER may choose, for example, a subject matter or color variations, for example, a painting from a photograph. However, the COSTUMER must bear in mind that ARTWORK is a personal choice and must be clear if the COSTUMER has any specific requirements. COMMISSIONS require a non-refundable 100% deposit to be paid in advance.

COSTUMER” means the person who COMMISSION’S the ARTIST and pays for the work.

ILLUSTRATION” means full digital drawing with characters and background which consists of one scene. Each ILLUSTRATION itself is in digital version in A4 (1240 x 1754 pixels) size with resolution 150 dpi in PNG format if not agreed otherwise.

LINEART” means a drawing that consists of distinct black straight or curved lines placed against a background, without gradations in shade (darkness) or hue (color) to represent the scene/object/character in the ARTWORK.

SKETCH” means a rough drawing representing the page composition and chief features of a scene.

SPRITE” means character SPRITE, which may or may not consist of different layers and is on a transparent background. Each SPRITE or SPRITE layer group are in PNG format with transparent background with CUSTOMER specified height in pixels and resolution of 150 dpi unless agreed otherwise.

STORYBOARD” means textual organizer which describes each COMIC page for the purpose of establishing plot development.

2. ARTWORK

All the characters in the ARTWORK are 18 years old or older.

2.1. COMIC

The creation of the COMIC’S according to COSTUMER’S description will start only after receiving full payment upfront for the STORYBOARD plus the 1st page.

Every COMIC’S page will have a separate invoice sent and after the full payment upfront is received ARTIST will start working on it.

The work in progress images and the final version of each page will be send to COSTUMER’S specified e-mail address.

2.2. ILLUSTRATION

The creation of the ILLUSTRATION according to COSTUMER’S description will start only after receiving full payment upfront.

The work in progress image and the final version will be send to COSTUMER’S specified e-mail address.

2.3. SPRITE

The creation of the SPRITE according to COSTUMER’S description will start only after receiving full payment upfront.

The work in progress image and the final version will be send to COSTUMER’S specified e-mail address.

3. COMMISSION

By submitting an inquiry CUSTOMER confirms that CUSTOMER is of legal age.

The entire process can take anywhere between a few days to a few months depending on ARTIST’S workload. The ARTIST will let you know the time approximate necessary to complete the COMMISSION.

If COSTUMER needs COMMISSION to be done urgently then depending on the deadline ARTIST can ask for additional payment. ARTIST can decline to do a COMMISSION without any explanations.

Step 1: COSTUMER fills out the form with detailed COMMISSION information.

Step 2: If the ARTIST accepts the COMMISSION an e-mail with the price is send to the COSTUMER for acceptance.

Step 3: Once COSTUMER accepts it an invoice is sent to the provided e-mail address.

Step 4: After the payment is processed ARTIST starts working on COSTUMER’S COMMISSION.

3.1. COMIC

Step 5: ARTIST creates a STORYBOARD for whole COMIC and sends it to the COSTUMER. COSTUMER can ask for up to two rounds of changes before ARTIST starts working on the 1st page.

Step 6: COSTUMER receives a SKETCH of the page. COSTUMER can ask for up to two rounds of changes before ARTIST starts working on the LINEART.

Step 7: Next time ARTIST sends the LINEART of the page, COSTUMER can ask for up to two rounds of changes, but nothing major like pose changes.

Step 8.1: If COSTUMER commissioned inked comic then after step 7 the COMMISSION process for the page is considered to be fulfilled successfully, ARTIST sends an invoice for the next page and steps from 5 to 7 are repeated.

Step 8.2: If COSTUMER commissioned colored page then after the LINEAR is colored the COMMISSION process for the page is considered to be fulfilled successfully, ARTIST sends an invoice for the next page and steps from 5 to 8 are repeated until the last page done according to the STORYBOARD.

3.2. ILLUSTRATION

Step 5: COSTUMER receives a SKETCH of the ILLUSTRATION. COSTUMER can ask for up to two rounds of changes before ARTIST starts working on the LINEART.

Step 6: Next time ARTIST sends the LINEART of the ILLUSTRATION, again COSTUMER can ask for up to two rounds of changes in minor details(f.ex. facial expression).

Step 7: ARTIST sends the final ILLUSTRATION version, COSTUMER can ask for a minor changes once in the overall atmosphere, but nothing major like pose change or facial expression change, after that COMMISSION process is considered to be fulfilled successfully.

3.3. SPRITE

Step 5: COSTUMER receives a SKETCH of the SPRITE/ SPRITE layers. COSTUMER can ask for up to two rounds of changes before ARTIST starts working on the LINEART.

Step 6: Next time ARTIST sends the LINEART of the SPRITE/ SPRITE layers, again COSTUMER can ask for up to two rounds of changes in minor details (f.ex. facial expression).

Step 7: ARTIST sends the final preview of SPRITE/ SPRITE layers, COSTUMER can ask for a minor changes once in the coloring, but nothing major like pose change or facial expression change, after that COMMISSION process is considered to be fulfilled successfully.

4. PRICES

All the prices in price list are informative and not final, once the inquiry for the COMMISSION is sent, the ARTIST will reply to COSTUMER with the final price/s for the ARTWORK.

5. PAYMENT

Payment for the COMMISSION is done via Paypal (transfer fee is included in the final price).

6. CANCELLATION AND REFUND

COSTUMER can cancel the COMMISSION anytime before the payment is made, but once the payment was processed there will be no refund.

If ARTIST does not send a status update on a COMMISSION process for more then one month from the previous update date or can’t finish COMMISSION for some reason then COSTUMER will receive a full refund.

ARTIST retains copyright ownership and all reproduction rights to the ARTWORK. The artwork may not be reproduced in any manner, whatsoever, without a consent from the ARTIST.

ARTIST reserves the right to post, use and sell created art in digital or physical forms if not agreed otherwise. Profits won’t be shared.

ARTIST does not claim any rights to characters and other intellectual properties used in process of creation.

8. DATA PRIVACY

With the placement of the order the ordering party expressly agrees that ARTIST will use the ordering party’s e-mail as well as its previous orders to process the relevant inquires and to send messages regarding the COMMISSION. The COSTUMER may revoke its consent at any time by giving an e-mail notice to rivars.studio@gmail.com

9. CONCLUSION OF CONTRACT

Inquiries for a COMMISSION shall be submitted online, using an appropriate form made available by the ARTIST. The COSTUMER is obliged to provide the information requested in the form truthfully and completely.

10. PERFORMANCE, JURISDICTION APPLICABLE LAW

Place of performance and place of jurisdiction shall be Riga, Latvia. The contractual relationship shall be governed by and construed in accordance with international law.

Should any of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining terms hereof.
